S-3505 : Still Just a Bill

The Defense Support for Cyber Emergencies Response Act of 2023, also known as S. 3505, amends Title 10 of the United States Code to authorize the Secretary of Defense or the Secretary of the department in which the Coast Guard is operating to order units of the Selected Reserve to active duty in order to respond to significant cyber incidents.

• This can be done without the consent of the member affected.
• Active duty orders under this authority cannot exceed 365 consecutive days.
• The bill defines "covered incident" to include cyber incidents that pose a significant threat to national security, foreign relations, the economy, public confidence, civil liberties, or public health and safety.
• It outlines termination of duty protocols by order of the Secretary of Defense (or Coast Guard) or by law.
