The Pharmacy Access Oversight and Reporting Act (S. 2939) aims to increase transparency in the enforcement of pharmacy access requirements under Medicare Part D. The bill amends Section 1860D-42 of the Social Security Act by adding a new subsection that mandates the Secretary of Health and Human Services to publish a biennial report on the enforcement and oversight of pharmacy access requirements outlined in section 1860D-4(b)(1) of the Social Security Act.

The report must be published every two years.

The report cannot include:

  • Identifiable information about individuals or entities unless the information is already publicly available.
  • Trade secrets of any entities.
