S-1469 : Still Just a Bill

The "Stop Stolen Valor for Service-Disabled Veteran-Owned Small Business Contractors Act" (S. 1469) aims to prevent fraud in government contracting by requiring small businesses to be certified as service-disabled veteran-owned small businesses (SDVOSB) to be counted toward federal contracting goals. Key provisions include:

  • Certification Requirement: Mandates that to be counted towards SDVOSB contracting goals, small businesses must be certified by the Small Business Administration (SBA) as SDVOSBs.
  • Eliminates Self-Certification: Ends the practice of self-certification for SDVOSBs in prime contracting and subcontracting.
  • Phased Implementation: Allows a one-year grace period for existing self-certified SDVOSBs to apply for certification, during which they can maintain their self-certified status. After one year, those who have not applied will lose their self-certified status.
  • Rulemaking: Requires the SBA Administrator to issue regulations to implement the Act within 180 days of enactment. The certification requirement takes effect on October 1 of the fiscal year following the publication of these regulations.
