H.R. 9643, also known as the "Right to IVF Act," seeks to protect and expand access to fertility treatment, including in vitro fertilization (IVF), nationwide. The bill is composed of four titles:

  • Title I: Access to Family Building Act
    • Establishes statutory rights for individuals to receive fertility treatment, for healthcare providers to provide such treatment, for health insurance issuers to cover fertility treatment, and for manufacturers to market drugs or devices used in fertility treatment, without undue prohibition, limitation, or impediment.
    • Allows the Attorney General to take civil action against states or entities that enact limitations on these rights.
  • Title II: Veteran Families Health Services Act
    • Requires the Department of Defense to provide fertility treatment and counseling to members of the uniformed services and their spouses or partners.
    • Directs the establishment of procedures for fertility preservation for members whose fertility is jeopardized due to injury or illness during active duty.
    • Allows members of the uniformed services to cryopreserve and store their reproductive genetic material before deployment to combat zones or hazardous duty assignments.
    • Requires the Department of Veterans Affairs to furnish fertility treatment and counseling to certain veterans and their spouses or partners.
    • Mandates coordination of reproduction and fertility research for veterans between the Department of Veterans Affairs, the Department of Defense, and the Department of Health and Human Services.
  • Title III: Access to Fertility Treatment and Care Act
    • Amends the Public Health Service Act (PHSA), the Employee Retirement Income Security Act (ERISA), and the Internal Revenue Code (IRC) to require group health plans and health insurance issuers to provide coverage for fertility treatment if they provide coverage for obstetrical services.
    • Requires state Medicaid plans to provide medical assistance for fertility treatment.
    • Includes fertility treatment as a covered service under Medicare.
  • Title IV: Family Building FEHB Fairness Act
    • Amends title 5 of the United States Code to include fertility treatment benefits in the Federal Employees Health Benefits (FEHB) Program.
