HR-6405 : Still Just a Bill


The Lori Jackson-Nicolette Elias Domestic Violence Survivor Protection Act, also known as H.R. 6405, aims to protect victims of domestic violence by amending Title 18 of the United States Code and the Omnibus Crime Control and Safe Streets Act of 1968. The bill expands the definition of "covered domestic violence court order" and "intimate partner" to include dating partners and others similarly situated to spouses.

  • Firearm Restrictions: The bill broadens restrictions on firearm possession and purchase to include individuals subject to domestic violence restraining orders.
  • Grant Program: It establishes a grant program to assist states and tribes in implementing policies and procedures for the removal of firearms from individuals adjudicated as domestic violence offenders.
  • State and Tribal Policies and Procedures: States and tribes are directed upon the issuance of a domestic violence protection order, to issue an additional firearm surrender order, which is in effect for the duration of the domestic violence protection order, to surrender physical possession of all firearms and ammunition in the possession, care, custody, or control of the individual.

The Act also includes technical and conforming amendments to the NICS Improvement Amendments Act of 2007, replacing references to "court order (as described in section 922(g)(8)" with "covered domestic violence court order (as defined in section 921(a))".
